This is the Privacy Notice (the “Privacy Notice”) of Boatter LLC (“Boatter,” “we,” or “us”), whose principal office is located at [Boatter LLC, 2645 Executive Park Dr, Weston, Florida 33331]. This Privacy Notice explains how Boatter collects and processes your Personal Data when you access and use the services provided by Boatter (the “Services”), including (but not limited to) the use of our website at www.boatter.com (the “Site” or “Website”), and describes certain rights you may have in relation to your Personal Data under applicable law.

This Privacy Notice relates to data about you and your interaction with our Services. For purposes of this Privacy Notice, “Personal Data” means any information relating to an identified or identifiable natural person (each such person, a “data subject”). An identifiable natural person can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

Registration

We collect Personal Data when you use or interact with our Site and Services, including when you register with us. To create an account with us, you will need to provide your name, email address, and a password. We may also request a phone number and other contact details to help support account security and communication.

Interaction with Our Site and Subscription Purchases

We collect Personal Data when you use or interact with our Site and Services, including when you browse listings, manage your boats, or purchase a subscription plan to list boats on Boatter. To pay for a subscription plan or other paid services offered by Boatter, you will need to provide payment and billing information to us or to our third-party payment processor (such as payment card details, billing address, and related information).

Boatter does not process or handle rental payments between Renters and Boat Owners. Any fees, deposits, or other financial arrangements related to boat rentals are handled directly between Users (and any third-party payment providers they choose) outside of Boatter’s payment flow.

Profile

You can choose the information you include in your profile, such as a profile photo, spoken languages, location, and a short biography. You are not required to provide additional information beyond what is needed to create an account; however, profile information may help you get more value from our Services and improve your visibility to other Users.

Other than the information required to create an account (e.g., your name, email address, and password, and optionally a phone number), it is your choice whether to include additional Personal Data on your profile. We do not require you to provide sensitive Personal Data to complete your profile. We recommend that you exercise care when deciding what information and content you wish to disclose in areas of our Site accessible to other Users or the general public. Please do not post or add Personal Data to your profile that you would not want to be publicly available.

Listings and Content You Submit

Our Services allow Boat Owners and other Users to post content, including:

  • boat listings (e.g., boat details, photos, pricing, and availability);
  • descriptions of services or experiences related to boating;
  • reviews, ratings, and feedback; and
  • other text, images, or media.

When you create a listing or post other content, we collect the information you provide in connection with that content.

  • view or click on listings;
  • perform searches;
  • update or manage your listings;

  • install, open, or update any Boatter mobile application (if and when available).

We use log-ins, cookies, device information, and Internet Protocol (“IP”) addresses to identify you and log your use.

  1. Users Under 16 Years of Age

Boatter does not knowingly collect Personal Data online from individuals under 16 years of age without parental consent. If we discover that an individual under 16 has provided Personal Data without parental consent, we will take steps to delete such data as permitted by law.

How We Use Your Data

We use your Personal Data as described in this Privacy Notice. How we use your Personal Data may depend, in part, on how you use our Services and the choices you make in your settings.

We use the data we have about you to provide, improve, and personalize our Services (including with the help of automated systems and inferences we make), so they can be more relevant and valuable to you and others.

  1. Boat Listings and Marketplace Matching

Boatter helps connect Users who own or control boats with Users interested in renting boats. To do so, we may use your data to:

  • enable you to create and publish listings for your boats or services;
  • help other Users discover your listings (for example, by displaying listings in search results, recommendations, or marketing emails);
  • present listings that may match your preferences, filters, or location; and
  • facilitate communication between Users regarding listings and potential rentals.

Please note that Boatter does not process rental payments between Users. Any bookings, rental payments, or related arrangements take place directly between Boat Owners and Renters (and any third-party payment or escrow providers they choose), outside of Boatter’s payment system.

  1. Subscriptions and Billing for Boatter Services

We use Personal Data to:

  • manage and process subscription payments for Boatter’s own paid services (such as boat listing plans or promotional tools);
  • maintain billing histories;
  • send invoices, payment confirmations, or subscription status messages; and
  • address questions or issues related to billing and account status.

Payment card information is typically processed by our third-party payment processor(s). Boatter itself does not store full payment card numbers, except as permitted and in accordance with applicable law and industry standards.

  1. Communications and Marketing

We may contact you via email, phone, SMS, in-app messages, push notifications, or notices posted on our Site or apps to:

  • send important account or security alerts;
  • provide information about the availability or changes to our Services;
  • send reminders related to subscription renewals or inquiries you have received;
  • provide tips on how to use the platform or improve listing performance; and
  • send promotional messages about Boatter’s services, features, or offers that may be of interest to you (subject to your preferences and applicable law).

We also enable communications between Users through Boatter (for example, inquiries and responses about listings). You may adjust your communication preferences through your account settings, although certain essential or transactional communications (such as security alerts or legal notices) may not be subject to opt-out.

No mobile information will be shared with third parties/affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

  1. Developing Our Services and Research

Service Development and Analytics

We may use de-identified, aggregated, or anonymized data (and, where appropriate, identifiable data) to:

  • develop research, reports, and insights.

Customer Support

Certain information you provide may be visible to others:

  • Public User Profile: Information you choose to include on your public profile (such as your display name, profile photo, description, and general location) may be visible to other Users and, in some cases, to visitors of the Site.
  • Listings: When you create a boat listing, the listing details (photos, description, pricing, etc.) will be publicly viewable on the Site.
  • Reviews and Public Content: When you submit reviews, ratings, or other public content, it may be visible to the general public, along with your display name and, if provided, your profile photo.

For example, if you use our Services periodically to list or rent boats, we may retain your information as long as your account is open to make it easier for you to return to the platform.

Account Closure

If you wish to close your Boatter account, you may contact our Support Team or use any account closure feature we provide. Your Personal Data will generally stop being publicly visible on the Site within a reasonable period (e.g., 72 hours) after we process your request.

We generally delete closed account information from our active systems within a reasonable period (for example, 30 days) after account closure, except where:

  • we are required to retain data by law or regulation;
  • it is necessary to resolve disputes, enforce agreements, maintain security, or prevent fraud and abuse; or
  • It is needed to honor your request to “unsubscribe” from communications or for other legitimate business purposes.

Information you have shared with others (e.g., reviews or public posts) may remain visible after account closure, and your profile may continue to appear in search engine results until those third-party services refresh their cache.
