RENTER INTERFACE TERMS OF USE

Effective Date: February 2026

These Renter Interface Terms of Use (the “Renter Terms”) govern your access to and use of the Boatter.com platform as a renter (“Renter,” “you,” or “your”).

By accessing or using Boatter.com, you agree to these Renter Terms, the Boatter Terms of Use, and the Boatter Privacy Policy (collectively, the “Terms”). If you disagree, you must not use the Services.

  1. Platform Role & Marketplace Disclaimer

Boatter.com is an online technology platform that facilitates connections between renters and independent boat owners or operators (“Members”).

Boatter:

  • Does not own, operate, manage, inspect, or insure vessels
  • Is not a broker, charter operator, carrier, agent, or insurer
  • Is not a party to rental agreements between Renters and Members

All rentals are entered directly between you and the member.

  1. Eligibility & Account Registration

You must:

  • Be at least 18 years old (or older if required by local law)
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

I want you to know that you are responsible for all activity conducted through your account.

  1. Booking & Rental Agreements

When you book a vessel through Boatter:

  1. You enter into a direct rental agreement with the Member
  2. The Member is solely responsible for:
    • Vessel condition and seaworthiness
    • Licensing, insurance, and compliance
    • Crew and captain qualifications
  3. Boatter does not guarantee the availability, safety, or performance of any vessel

You agree to review the listing details carefully before booking.

  1. Pricing & Payments

Transparent Pricing

All listings must display total pricing upfront, including mandatory fees known at the time of booking.

The member must clearly disclose optional charges (e.g., fuel, add-ons, gratuities).

Payments

  • Payments are processed through Boatter’s approved payment systems
  • Direct off-platform payments initiated through Boatter are prohibited
  • Currency conversion fees (if applicable) will be disclosed before payment

Boatter does not charge renters a commission for bookings unless expressly disclosed.

  1. Cancellations & Refunds

Member-Initiated Cancellations

If a member cancels:

  • You may be eligible for a full refund or reschedule
  • Weather-related cancellations are evaluated based on safety considerations

Renter-Initiated Cancellations

Renter cancellations are subject to the member’s stated cancellation policy, unless otherwise required by law.

Booking Errors

If you made a genuine booking error (wrong date/time) and cancel within 24 hours, Boatter may, at its discretion, facilitate a full refund.

  1. Weather & Safety Acknowledgement

You acknowledge that boating activities involve inherent risks, including weather variability.

  • Members make final safety decisions regarding weather
  • Boatter does not evaluate or intervene in weather decisions
  • You agree to comply with all safety instructions provided by the Member
  1. Renter Responsibilities & Conduct

You agree to:

  • Follow all safety instructions and applicable laws
  • Operate vessels only if authorized and qualified
  • Treat vessels, crew, and property with care
  • Refrain from illegal, reckless, or abusive conduct

You are responsible for any damage caused by you or your guests.

  1. Prohibited Activities

You may not:

  • Misrepresent your identity or qualifications
  • Circumvent Boatter’s payment systems
  • Harass or abuse Members or crew
  • Use the platform for unlawful purposes
  • Attempt to scrape, copy, or misuse platform data

Violations may result in account suspension or termination.

  1. Reviews & Content

You may submit reviews or feedback, provided that such content is

  • Truthful and non-defamatory
  • Based on your experience
  • Free of harassment or abusive language

By submitting content, you grant Boatter a non-exclusive license to display and use it.

  1. Taxes & VAT (EU / UK / International)
  • Applicable taxes may be included in the booking price or disclosed separately
  • VAT responsibilities depend on the Member’s legal obligations
  • Boatter is not responsible for determining tax applicability on rentals

Where required by law, Boatter may collect and remit certain taxes.

  1. Data Protection & Privacy (GDPR / UK GDPR)
  • Boatter acts as a Data Controller for platform operations
  • Members act as independent Data Controllers for rental transactions
  • Your personal data is processed in accordance with the Privacy Policy

You may exercise your data subject rights as required by applicable law.

  1. Assumption of Risk & Liability Waiver

You acknowledge and agree that:

  • Boating involves inherent risks
  • Participation is voluntary and at your own risk
  • Boatter is not responsible for injuries, accidents, or losses

To the fullest extent permitted by law, you release Boatter from liability arising from rentals.

  1. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE.”

Boatter disclaims all warranties, including:

  • Vessel condition or fitness
  • Member performance
  • Availability or uninterrupted service
  1. Limitation of Liability

To the maximum extent permitted by law, Boatter shall not be liable for:

  • Personal injury or property damage
  • Booking disputes
  • Lost profits or indirect damages

Total liability, if any, shall not exceed the amount paid by you to Boatter in the prior 12 months.

  1. Indemnification

You agree to indemnify and hold harmless Boatter from claims arising out of:

  • Your conduct
  • Your breach of these Terms
  • Your violation of the law or third-party rights
  1. Suspension & Termination

Boatter may suspend or terminate your access at any time for violations of these Terms or applicable law.

  1. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.

The exclusive venue lies in Delaware courts, except where mandatory consumer law applies.

  1. International Users

Nothing in these terms limits non-waivable consumer rights under EU or UK law.

If any provision is unenforceable in a jurisdiction, it shall be modified to the minimum extent necessary.

  1. Modifications

Boatter may update these terms from time to time. Continued use means acceptance of revised terms.
